1p-photo Terms of Use

1. Introduction

Welcome to 1p-photo (“App”). These Terms of Use (“Terms”) govern your access to and use of the App, which enables you to upload and enhance photographs, primarily of people. By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. User Content and Copyright

• You retain all rights to the photos you upload.
• By uploading photos, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and modify your photos solely to provide the App’s enhancement services.
• You confirm that you have all necessary rights, permissions, and consents from any individuals depicted in your photos.
• You agree not to upload content that infringes third-party rights, is unlawful, or violates privacy or data protection laws.

3. Data Protection and Privacy

• We process your photos and any personal data in accordance with our Privacy Policy and applicable data protection laws.
• You are responsible for obtaining any necessary consents from individuals in your photos before uploading.

4. Third-Party Processing

• 1p-photo uses third-party service providers via API to enhance your photos.
• By uploading an image, you consent to your image being securely transmitted to and processed by our third-party enhancement provider.
• The processing of your image may be subject to the third-party provider’s terms and privacy policy, which we encourage you to review.
• While we select our partners carefully, we are not responsible for the acts or omissions of these third parties.
• If you do not agree to this, please do not use the App.

5. User Responsibilities

• You agree not to upload illegal, offensive, harmful, or inappropriate content.
• You may not use 1p-photo for commercial purposes without our explicit written consent.
• You agree not to attempt to reverse engineer, copy, or misuse the App or its outputs.

6. Limitation of Liability

• 1p-photo is provided “as is” without warranties of any kind.
• We do not guarantee uninterrupted or error-free service.
• To the fullest extent permitted by applicable law, we exclude liability for any damages arising from your use of the App, except where such liability cannot be excluded by law.
• We are not responsible for any loss, misuse, or unauthorised access to your uploaded photos, including any issues arising from third-party processing.

7. Account Suspension and Termination

• We reserve the right to suspend or terminate your access to 1p-photo if you breach these Terms or for operational reasons.
• You may delete your account at any time. Upon request, we will delete your photos and data, subject to any legal retention requirements.

8. Intellectual Property

• All intellectual property rights in the App (excluding user-uploaded content) belong to us or our licensors.
• You may not use our trademarks, logos, or branding without prior written permission.

9. Governing Law and Jurisdiction

• These Terms are governed by the laws applicable in your country of residence, except where local law does not apply.
• Any disputes arising from these Terms or your use of 1p-photo will be resolved in accordance with the laws and courts of your country of residence, unless otherwise required by applicable law.
• We make no representation that the App or its content is appropriate or available for use in all locations. Users are responsible for compliance with all applicable local laws and regulations.

10. Changes to These Terms

• We may update these Terms from time to time. Continued use of 1p-photo after changes means you accept the updated Terms.
• We recommend you review these Terms periodically.

11. Returns and Refunds

• As our services are digital and personalized, all sales are final and we do not offer returns or refunds once your photo enhancement has been processed, except where required by applicable law.
